These Terms of Service (“Terms”) govern access to and use of Backup Pulse. Backup Pulse is operated by Levent Soykan, trading as Backup Pulse (“Backup Pulse”, “we”, “us” or “our”). By creating an account or using the service, you agree to these Terms.
1. The service
Backup Pulse is a software-as-a-service platform that complements existing backup products by collecting backup evidence, monitoring backup status, detecting failed or missed backups, tracking recovery validation activities, and presenting backup health and recovery-readiness information.
Backup Pulse is not backup software, does not create or store your primary backups, and does not itself perform disaster recovery or guarantee that any backup can be successfully restored.
2. Accounts and organizations
You must provide accurate account information and keep your credentials secure. You are responsible for activity performed through your account and for ensuring that people you authorize to use your organization have appropriate permission to access the information submitted to Backup Pulse.
3. Customer data and backup evidence
You retain ownership of data and evidence you submit to the service. You grant Backup Pulse the limited rights necessary to receive, store, process, display, and otherwise handle that data to provide, secure, maintain, and support the service.
You are responsible for ensuring that you have the necessary rights and authority to submit data to Backup Pulse, including backup notification emails, system information, and recovery-validation records.
4. Acceptable use
You may not use Backup Pulse unlawfully; attempt to gain unauthorized access to the service or another customer's data; interfere with service operation; introduce malicious code; misuse monitoring endpoints; or use the service to infringe the rights of others.
5. Trials and subscriptions
Backup Pulse may offer free trials or evaluation access. Trial features, duration, and limits may be changed or withdrawn before a paid subscription begins. Paid plans, included features, billing periods, and prices are shown on the pricing or checkout pages before purchase.
Where a paid plan renews automatically, the applicable billing interval and recurring price will be shown before purchase. You may cancel a subscription to prevent future renewal charges. Unless otherwise required by law or a refund is approved, cancellation takes effect at the end of the current paid billing period.
6. Payments and Paddle
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
For transactions processed by Paddle, your purchase is also subject to Paddle's applicable buyer terms. Paddle handles payment processing, applicable transaction taxes, receipts, subscription billing, and approved refunds. Backup Pulse does not receive or store your full payment-card details.
7. Refunds
Refunds and applicable withdrawal rights are described in our Refund Policy. Where Paddle processes the transaction, refund requests are handled through Paddle as Merchant of Record. Mandatory consumer rights are not limited by these Terms.
8. Availability and changes
We aim to provide a reliable service, but uninterrupted or error-free availability is not guaranteed. We may maintain, modify, improve, or discontinue features where reasonably necessary. Material changes affecting a paid subscription will be handled in accordance with applicable law and any commitments made at purchase.
9. Backup and recovery decisions
Backup Pulse provides monitoring, evidence, alerts, reports, and recovery-readiness indicators to assist operational decision-making. These outputs do not replace appropriate backup administration, restore testing, disaster-recovery planning, or professional judgment. You remain responsible for your backup configuration, retention, security, recovery procedures, and business-continuity decisions.
10. Intellectual property
Backup Pulse and its software, branding, site content, designs, and related materials are owned by or licensed to Backup Pulse. Except for the limited right to use the service under these Terms, no intellectual-property rights are transferred to you.
11. Suspension and termination
We may suspend or terminate access where reasonably necessary to address material breach, unlawful or abusive use, security risk, non-payment, or threats to the service or other users. You may stop using the service and cancel a paid subscription in accordance with the applicable subscription process.
12. Disclaimers and liability
To the extent permitted by applicable law, the service is provided on an “as available” basis. Backup Pulse does not warrant that monitoring evidence will identify every backup problem or that a backup, system, or workload will be recoverable.
Nothing in these Terms excludes or limits liability or rights that cannot lawfully be excluded or limited. To the extent permitted by law, Backup Pulse will not be liable for indirect, incidental, special, or consequential loss arising from use of the service, including loss caused by failure of third-party backup products, infrastructure, or services outside Backup Pulse's control.
13. Privacy
Our handling of personal data is described in the Privacy Policy. Paddle separately processes buyer and transaction information under its own privacy notice when acting as Merchant of Record.
14. Changes to these Terms
We may update these Terms to reflect changes to the service, law, security requirements, or commercial arrangements. The updated version will be published on this page with a revised effective date. Where required by law, we will provide additional notice.
